Terms and conditions

The rules for using Buchsnap.

This translation is provided for convenience. In case of any discrepancy, the German version prevails.

1. Scope

These terms and conditions govern the use of the Buchsnap platform, provided by Alin Ghiorghiu, a sole proprietorship (Einzelfirma) based in Kloten ("Buchsnap"). They apply to accounting firms ("accountants") and to the businesses that work with them ("clients").

2. Services

Buchsnap provides accounting software: capturing and storing receipts, the journal, VAT reports, invoices, reports and the other features of the chosen plan. Buchsnap does not provide fiduciary, tax or legal advice. Responsibility for entries, financial statements and tax returns lies with the client and their accountant.

3. Sign-up

Accountants sign up free of charge. Buchsnap reviews every sign-up and may reject it without giving reasons. Clients are set up by their accountant. Login details are confidential, and each person uses their own account.

4. Plans and prices

Buchsnap is free for accountants. Clients pay the prices for the BASIC, PLUS and PRO plans published at buchsnap.ch/en/pricing, in each case per month and per company, plus VAT. The accountant's services are not included and are invoiced separately by the accountant.

5. Invoicing and payment

The subscription is invoiced one period in advance, either to the company or, where agreed, to the accounting firm. The payment deadline is stated on the invoice. If payment is overdue, Buchsnap may restrict the features to the BASIC plan after a grace period. No data is deleted as a result.

6. Term and termination

The subscription runs for the period paid for. If it is not renewed, it ends when that period expires. Accountants may close their account at any time, provided they no longer manage any clients through it.

7. Data and export

The data belongs to the client, who can download an archive of receipts and reports for each financial year. Once the contract has ended, the data is deleted after 90 days unless a statutory obligation requires otherwise. For accounting data, Buchsnap acts as a processor, as described in the privacy policy.

8. Availability

Buchsnap endeavours to ensure trouble-free operation but does not guarantee uninterrupted availability. Wherever possible, we carry out maintenance outside office hours.

9. Users' obligations

Users must use Buchsnap lawfully, must not upload harmful content and must protect their login details, ideally with two-factor authentication.

10. Liability

Buchsnap is liable only for damage caused intentionally or through gross negligence. To the extent permitted by law, liability for slight negligence, consequential damage and loss of profit is excluded.

11. Changes

Buchsnap may amend these terms and conditions and its prices by giving at least 30 days' notice. Anyone who does not agree may terminate the subscription with effect from the date on which the changes take effect.

12. Governing law and jurisdiction

These terms and conditions are governed by Swiss law. Unless the law provides otherwise, the place of jurisdiction is Buchsnap's registered office.

Legal basis

Swiss law applies, in particular the Swiss Code of Obligations (CO).
